Miranda v. Arizona
Ernesto Miranda was a mexican immigrant. His criminal record consisted of armed robbery, attempted rape, assault, and burglary. In 1963, he was arrested for kidnapping and raping a young woman. Following being arrested, Miranda was interrogated by police for 2 hours. The case went to court and Miranda was found guilty because of his confession. He appealed the case, on the account that he was not informed of his 5th amendment, and the case went all the way to the Supreme Court
Setting Precedents This case set a legal landmark for all those with charges put against them. They are to be read their 5th amendment rights at the time of arrest so that all regulations and rights whiich they are protected under are made clear. Ernesto Miranda's case was overturned under these circumstances and he was released.
''You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense.''
