the Powers of FEDERALISM
Governmental powers are divided in two ways: 1. between states and the federal government 2.among the three branches of government
Types of Powers in Federal Sytem of Government
federalism: the sharing of powers between the national and state governments
Delegated Powers or Enumerated Powers : the powers of Congress established by Article 1 Section 8 of the US Constitution they are given to the national government only EX: ''The Congress shall have the power to provide and maintain a navy''
Reserved Powers : under the 10th Amendment, the powers that the US Constitution does not give to the federal government, or forbid to the states, are reserved to the states EX : marriage laws
Implied Powers : powers that are not stated in the Constitution, but are implied by the government's need to carry out all of its functions they come from what is called the ''Necessary and Proper'' clause from Article 1, Section 8, ''Clause 18'' of the Constitution EX: Creation of the Air Force. When the Founding Fathers first wrote the Constitution there were no planes. The national government created the Air Force later to help the country defend itself against attack.
Inherent Powers : powers that belong to the national government because the it is the government of a sovereign nation, the government has the natural right to ensure its own survival EX: to make peace treaties and war - to fight for protection and rights of people
Prohibited Powers : powers that are denied to both the national and state government in states vs. national writting by the silence of the Constiution because of our system of government EX: the states are not allowed to tax exports or imports the federal government is not allowed to tax exports
Concurrent Powers : powers shared by the federal and state governments EX : although there are different federal and state court systems, both have the power to convict people of crimes and hold them in jail
Expressed Powers : powers delegated to the national government in so many words, specifically spelled out in the Constitution EX: (Article I Section 8 of the Constitution) Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defence and general welfare of the United States
Exclusive Powers : powers can be exercised only by the national government includes delegated powers EX: external power: these powers deal with international affairs
