DR.. SEUSS ENTERPRISES VS. PENGUIN BOOKS
When and Where? The case between Dr.Suess and Penguin books took place in The U.S. 9th Ciruit Court of Appeals. The case was submited on October 10, 1996.
Background Info. Penguin Books published a book by an auther named Dr. Juice portraying the O.J. Simpson murder trial. Dr. Suess Enterprises sued Penguin Books because they believe Penguin Books violated trademarks and copyrights owned by Dr. Suess Enterprises.
Dr. Seuss enterprises sued penguin books for copyright and trademark infringement. To prove that copyright and trademark infrigement was commited they need to prove that there were distinct similarities between the two books and that they did indeed own the copyrights and trade marks for the book the cat in the hat.
The book that penguin books published was called the Cat Not In The Hat. It showed many similarities to Dr.Suess's book The Cat In The Hat.
The court decided that there was enough proof to prove that penguin books commited copyright and trademark infringement. The court decided to teminate the publication and distribution of penguin books book The Cat Not in The Hat.
