Assault is the threat or attempt to strike someone, whether it is successful or unsuccessful. The target must be aware that there is danger, and the assaulter must be reasonably capable to carry through with the attempt to harm. An assault can only take place when there is the present ability to act.Under criminal assault laws, it is not necessary for the victim to have sustained physical harm, the threat to harm is enough to constitute as assault and lead to assault charges. There are different degrees of assault that can either constitute as a misdemeanor assault or a felony assault. When a person is charged with assault, consequences include imprisonment, probation or parole, fines, loss of the right to possess firearms, and mandatory anger management classes depending of the degree of the assault.
Mayhem consists of maliciously causing the deprivation of a body part, disabling or disfiguring a body part such as cutting person's tongue or putting out a person's eye.Mayhem is a serious crime that is punishable by the law, and, therefore requires a skilled criminal defense lawyer that can protect your rights and minimize the damage.
Assault 13-1203. Assault; classificationA. A person commits assault by:1. Intentionally, knowingly or recklessly causing any physical injury to another person; or2. Intentionally placing another person in reasonable apprehension of imminent physical injury; or3. Knowingly touching another person with the intent to injure, insult or provoke such person.B. Assault committed intentionally or knowingly pursuant to subsection A, paragraph 1 is a class 1 misdemeanor. Assault committed recklessly pursuant to subsection A, paragraph 1 or assault pursuant to subsection A, paragraph 2 is a class 2 misdemeanor. Assault committed pursuant to subsection A, paragraph 3 is a class 3 misdemeanor.

■Simple Battery – The lowest form of a battery charge. Some harm or violent force was used, but it may not have been severe or life threatening. Typically a misdemeanor offense. ■Aggravated Battery – A more serious felony battery charge, typically resulting from more severe or serious injury.
Aggravated mayhem is the act causing permanent disability or disfigurement. It is done with the specific intent of causing injury and with indifference to the well-being of another person.Arizona laws seem to be all combined when it comes to assault, battery and mayhem. The punishment seems to depend on the severity of the crime, yet does not fall into a different category nor is it punishable as more than one crime.
