The constitution is short and is the basis skeleton of the United States. It has been formally changed 27 times over the years.. Today, there are five basic ways to informally change the constitution.
Congress is responsible for the filling of the gray areas in the constitution of the US.
The constitution allows Congress to control foreign and interstate commerce. There are many open holes in the constitution as to what that actually allows congress to control. Congress has passed many laws to exercise their control over commerce and state what they control.
An example of Congress filling in the missing parts of the constitution is Article III, section 1, '' the constitution provides for one supreme court, and... such inferior Courts as the Congress may from time to time ordain and establish.'' All federal courts, except for the Supreme Court have been set up by Congress.
The way Presidents use their power has also contributed to the growth of the constitution. For example, the congress is the only one who is allowed to declare war but the President is in charge of the armed forces. Presidents have caused war on their own by using the armed forces on other countries.
Executive agreement- a pact made by the president directly to another leader of a foreign state and does not need permission from the senate. Treaty- a formal agreement between two or more soverign states.
The supreme court interprets the constitution for every court case they hear.
The political Parties have as well been a major source of change despite the fact that the costitution makes no mention to them. Although unwanted by many Framers these parties developed and have been the ones to nominate candidtates for presidency since their creation in the 1830's.
The parties converted the elctoral college, the group that makes the forlal selection for the presiden, From what the Framers intended into a 'Rubbber Stamp' for each State's popular vote in presidential elections. Customs By custom, not because the constitution says so, the head of the 15 executive department makes up the cabnet, advisor body for president.
